6. The 2026 Legal Landscape for HNW Couples

The Supreme People's Court's Interpretation (II) on marriage and family, in force since February 1, 2025, clarifies how the Civil Code applies to issues that come up again and again in high-net-worth divorces: parental funding of homes, changes to property titles, transfers to third parties, company shares and custody disputes. The core framework is unchanged: property acquired during the marriage is still generally joint, and custody is still decided by the child's best interests. What has changed is how precisely courts now handle these recurring situations.

7. Key Legal Changes (Effective 2025)

Parental Funding, Title Transfers and Company Shares

Property acquired during the marriage remains joint unless the spouses have agreed otherwise in writing. Title in one spouse's name does not, on its own, change that. The new rules give courts clearer guidance where parents helped buy the marital home, where one spouse added the other to a property title, or where company shares are held in one spouse's name. A court can award a property to one spouse and order fair compensation to the other. That makes records of who paid what, and on what terms, especially valuable.

Gifts to Third Parties and Hidden Spending
Joint money or property given to a lover or cohabiting partner can be recovered, because such gifts are treated as void. Large unauthorized spending, such as livestream tipping far beyond normal household spending, can be treated as squandering joint property, and the spouse responsible may receive a smaller share on divorce. This gives the other spouse real remedies where assets have been quietly moved away.

Household Contributions and Custody
